1. These terms

These terms apply to every order you place with Aquamena and to your use of this website. By placing an order — by WhatsApp, telephone, through a driver or in writing — you accept them. If you are ordering for a company, you confirm you are authorised to do so on its behalf.

Where you hold a signed supply agreement with us, that agreement takes precedence over these terms to the extent the two conflict.

2. About us

3. Placing an order

An order is placed when you tell us what you want and where it goes. It is accepted when we confirm it to you, or when we deliver it — whichever happens first. We may decline an order, for example where we do not serve the area, the quantity is outside what we can supply, or a previous balance is unpaid.

You are responsible for giving us accurate delivery details and for telling us about access restrictions. If a delivery fails because the details were wrong or access was not possible, we may charge for the attempt.

4. Prices and offers

We do not publish a price list on this website. Prices depend on your area, the products ordered, the volume and the delivery frequency, and are confirmed to you before your first delivery. Prices are quoted in UAE Dirhams and include VAT where applicable.

We may change prices on notice. A price change does not affect an order we have already confirmed. Promotional offers are limited in time and quantity and may be withdrawn.

5. Payment

Household orders are normally paid on delivery in cash or by prepaid coupon. Business accounts are invoiced monthly and payable within the agreed term.

Where an invoice is not paid by its due date we may suspend further deliveries until it is settled.

6. Coupon books

Coupon books are prepaid and exchanged one coupon per bottle at the point of delivery. Coupons are not redeemable for cash. Lost or stolen books cannot be replaced unless we can verify the unused balance from our records.

7. Delivery

Delivery of five gallon bottles is free within the areas we serve — Ajman, Sharjah and Dubai. Deliveries run on fixed routes by area rather than to individual appointment slots; we tell you the day and do our best to keep to it.

If nobody is present, we will leave the order at the agreed handover point where it is safe and permitted to do so, and risk in the goods passes to you at that point. Full details are in our Delivery & Returns policy.

8. Returnable bottles

Five gallon bottles remain our property. They are issued to you for use and must be returned to us empty, in a reusable condition, on a subsequent delivery or when you stop your service.

You agree to use the bottles only for our water, to keep them out of direct sunlight, and not to store other liquids or substances in them. We may charge for bottles that are not returned, or that are returned damaged, contaminated or unfit for refilling.

9. Dispensers

Dispensers supplied by us are subject to the terms agreed when they are issued.

Where a dispenser remains our property, you agree to keep it in the condition supplied, to allow us reasonable access to sanitise and service it, not to move it to another address or open it for repair, and to return it when the service ends. You are responsible for loss or damage beyond fair wear and tear.

10. Product quality and your safety

Our water is purified, mineralised and bottled under a HACCP-based food safety system and is certified to the ESMA Emirates Quality Mark.

Check the seal before use. Do not use a bottle whose seal is broken or whose contents look or smell wrong — contact us instead and we will replace it. Store bottles upright, out of direct sunlight, away from chemicals and strong odours, and use the contents within a reasonable period of opening.

11. Changing or stopping a standing order

You may change the quantity or frequency of a standing order, pause it, or stop it, by telling us — a WhatsApp message is enough. Changes take effect from the next delivery where we receive them with reasonable notice before the route is loaded.

When you stop the service, all bottles and any dispenser belonging to us must be returned on the final collection.

12. Business accounts

Business and contract supply is provided under a separate supply agreement covering volumes, schedule, dispenser terms, pricing, invoicing and notice. Where no such agreement exists, these terms apply.

13. Our liability

We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, nor for business losses such as loss of profit, loss of business or loss of opportunity where you are using our products in the course of a business.

To the extent permitted by UAE law, our total liability in connection with any order is limited to the price paid for that order. Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

14. Events outside our control

We are not liable for failure or delay caused by something outside our reasonable control, including extreme weather, road or building closures, utility or supply failure, industrial action, or action by a public authority. We will tell you as soon as we can and reschedule the affected deliveries.

15. This website

This website is provided for information. We take care to keep it accurate but do not warrant that it is complete or current, and product descriptions are indicative. Images are illustrative and may not depict the exact item supplied. We may change or withdraw any part of the site without notice.

16. Intellectual property

The Aquamena name, the "Full Of Life" line, our logo, and the text, images and design of this website are owned by us or licensed to us. You may view and print pages for your own use. You may not copy, republish or use them commercially without our written permission.

17. Complaints

Tell us as soon as possible — by WhatsApp, by phone, or in writing to the address above. We aim to acknowledge complaints quickly and resolve them within a reasonable period. See Delivery & Returns for product issues and replacements.

18. Changes to these terms

We may revise these terms. The version published on this page at the time you place an order is the one that applies to it.

19. Governing law

These terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Ajman, and the courts of the United Arab Emirates have exclusive jurisdiction.
